Pilates Studio Terms and Conditions

1. Introduction
These terms and conditions (Terms) govern the use of services provided by Sabai Studio & Pilates with Cat ("Studio"), including memberships, packages, and other related services. By purchasing a membership or package and attending classes, you agree to be bound by these Terms.
2. Memberships
2.1. Membership Types
The Studio offers various membership plans, including but not limited to:
Monthly Memberships
Packages (e.g., 10-class packages)
Private Session Memberships
Each membership type is subject to specific terms, including fees, class access, and duration, as detailed at the time of purchase.
2.2. Membership Fees
Membership fees are paid in advance on a recurring basis, unless otherwise stated, and are non-refundable except as specified in Section 5 (Cancellations and Refunds). Membership fees will be automatically charged to the credit card or payment method on file on a 4 weekly billing cycle until the membership is canceled.
2.3. Renewals
Monthly memberships will automatically renew unless canceled at least 30 days prior to the renewal date. Class packages expire 90 days after purchase.
3. Class Packages & Private Packages
3.1. Validity
Class passes (e.g., drop-in classes, terms, or 10-class passes) are valid for a set period of time after purchase. The validity period will be stated at the time of purchase and can range from 1-90 days.
3.2. Non-Transferability
Class passes and memberships are non-transferable and may only be used by the individual who purchased them, unless otherwise specified by the Studio.
3.3. No Show and Late Cancel Policy
Clients must cancel a booked class at least 24 hours before the scheduled start time to avoid penalties. Failure to cancel within this timeframe will result in a forfeited class (for memberships and class passes) or the class fee (for drop-in bookings). No refunds will be given for no-shows or late cancellations.
4. Booking and Attendance
4.1. Class Booking
All classes must be booked in advance through the Studios online booking system or by contacting the Studio directly. Walk-in's are not accepted.
4.2. Arrival Time
Clients must arrive at least 5 minutes before the start of the class. Latecomers may be denied entry to avoid disrupting the class, and in such cases, the session will be considered forfeited.
4.3. Studio Etiquette
Clients are required to follow all studio guidelines, including proper attire, hygiene, and respect for others in the space. The Studio reserves the right to refuse entry or terminate memberships for behaviour deemed inappropriate or unsafe.
Members are required to follow the instructions of the teacher at all times.
Members shall not be allowed to attend any session whilst under the influence of alcohol or drugs. In the event they do attend, this is entirely at their own risk.
Members are not allowed to use any of the Studios equipment unsupervised and outside the sessions.
4.4. Children under the age of 16 may only attend private classes accompanied by a parent or guardian adult.
4.5. Members who suffer an accident or injury on the Companys premises must report the accident or injury and the circumstances in which it occurred immediately following the accident or injury to a staff member at the studio.
5. Cancellations, Suspensions, and Refunds
5.1. Membership Cancellations
Memberships can be canceled by providing written notice to the Studio at least 30 days before the next billing cycle. No partial refunds will be issued for unused portions of the membership.
5.2. Membership Suspension
Memberships may be temporarily suspended due to medical reasons or other valid circumstances for up to 3 months per calendar year. Requests for suspension must be made in writing.
5.3. Class Pass Cancellations
Class passes are non-refundable, except in cases of medical incapacity where a refund or extension may be granted at the Studios discretion. A written request is required.
5.4. Studio Cancellations
In the event the Studio cancels a class, clients will be notified as soon as possible and given the option to reschedule or receive a refund/credit for the canceled session.
6. Health and Liability Waiver
6.1. Health Declaration
By attending any class, clients declare that they are physically able to participate in Pilates exercises. If the client has any medical conditions, injuries, or is pregnant, they must consult their physician before participating in any class. The Studio reserves the right to request a doctors clearance in such cases.
By agreeing to these Terms and Conditions Members hereby confirm that they have no health problems (including without limitation cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma (or other breathing difficulties); diabetes, epilepsy or any allergy) which may affect their participation in any sessions at the Studio.
6.2. Pregnancy (Pre Natal and Post Partum)
Members may attend in-person group sessions from pregnancy until the end of their second trimester.
Members that participate in any exercise program, while pregnant or immediately following pregnancy, may increase the risk of injury to themselves and, if applicable, to their unborn child. Members hereby personally accept any and all risks associated with participating in exercise classes at the Studio.
Members who are pregnant, or immediately following pregnancy, understand that their level of participation in the exercise class and which exercise to perform must be determined by themselves, in consultation with their physician, and that the Studios and their teachers are not responsible for the intensity of their participation. Members shall undertake to stop all activity immediately if they feel any discomfort. Upon experiencing any discomfort at any time either during or after class, the member shall immediately contact their treating physician/GP/Midwife to inform him/her and seek advice.
Members who are pregnant, or immediately following pregnancy, understand that the teachers of the Studio are not physicians, nurses, or emergency medical technicians and that the teachers and the Studio, by making the exercise class available, are not undertaking any responsibility regarding the members medical condition(s).
Members who are pregnant, or immediately following pregnancy, hereby release, indemnify and hold harmless the Studio, its respective directors, officers, parents, subsidiaries, affiliates, agents, and the teachers of the exercise classes, from any and all claims, demands, personal injuries, costs, or expenses (including legal fees) arising from or relating in any way to their or their childs (born of unborn) participation in the exercise classes, now or in the future, except in so far as permitted by law and unless caused by the negligence of the Studio.
6.3. Liability Waiver
Clients assume all risk of injury and waive any claim they may have against the Studio, its instructors, employees, or agents for any personal injury or property damage sustained while participating in classes or on the premises.
7. Conduct and Termination of Services
The Studio reserves the right to terminate memberships or deny class access for behaviour that is disruptive, unsafe, or inconsistent with Studio policies. In such cases, no refund will be issued.
8. Changes to Terms and Conditions
The Studio reserves the right to change these Terms at any time. Clients will be notified of any significant changes via email or at the Studio. Continued use of the Studios services after such changes constitutes acceptance of the new Terms.
9. Privacy Policy and GDPR Compliance
9.1. Data Collection
The Studio collects and processes personal data from clients when they purchase memberships or class passes, book classes, or engage in other Studio activities. The types of personal data collected include but are not limited to:
Full Name
Contact Information (email, phone number, address)
Payment Information
Health Information (if necessary, for class participation)
9.2. Data Usage
Personal data is collected for the following purposes:
Managing class bookings and memberships
Communicating with clients regarding Studio services
Processing payments and billing
Ensuring client safety and suitability for certain classes (e.g., medical information for health-related concerns)
Data will not be shared with third parties without explicit consent, except as necessary for processing payments or complying with legal obligations.
9.3. GDPR Rights
If you are located in the European Union (EU) or European Economic Area (EEA), you have the following rights under the General Data Protection Regulation (GDPR):
Right of Access: You have the right to request access to your personal data that the Studio holds.
Right to Rectification: You have the right to request the correction of inaccurate or incomplete personal data.
Right to Erasure (Right to be Forgotten): You can request the deletion of your personal data, subject to legal and contractual limitations.
Right to Restriction of Processing: You can request that we limit the processing of your data under certain conditions.
Right to Data Portability: You can request to receive your personal data in a structured, commonly used format.
Right to Object: You can object to the processing of your personal data in certain circumstances, including for direct marketing purposes.
9.4. Data Security
The Studio takes appropriate technical and organisational measures to ensure the security of personal data and to protect it from unauthorised access, disclosure, or alteration.
9.5. Data Retention
The Studio retains personal data only for as long as necessary for the purposes for which it was collected, or as required by law. For example, payment data may be retained for accounting purposes for 7 years.
